Terms of Service

PLEASE READ THESE TERMS CAREFULLY BEFORE BOOKING. By completing a reservation with La Danta Salvaje, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service in their entirety. If you do not agree, do not proceed with a booking.

1. Definitions

"La Danta Salvaje," "we," "our," or "us" refers to La Danta Salvaje and its owners, operators, employees, guides, contractors, and agents. "Guest," "you," or "your" refers to the person making the reservation and all members of their party. "Reserve" refers to the La Danta Salvaje private rainforest reserve and lodge located on the Osa Peninsula, Costa Rica. "Services" refers to all lodging, guided activities, meals, day experiences, and any other offerings provided by La Danta Salvaje.

2. Agreement to Terms & Binding Contract

By completing payment for a reservation, you enter into a legally binding contract with La Danta Salvaje and agree to all terms herein. If booking on behalf of a group, you represent and warrant that you have the authority to bind all members of your party to these Terms and that you have informed all members of the conditions, risks, and requirements described herein. These Terms constitute the entire agreement between you and La Danta Salvaje and supersede any prior communications, representations, or agreements.

3. Nature of the Experience & Acknowledgment of Inherent Risks

YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT THE FOLLOWING CONDITIONS:

  • La Danta Salvaje is a remote, off-grid wilderness lodge with no road access. Reaching the lodge requires hiking 2+ km through primary tropical rainforest on uneven, potentially slippery terrain with river crossings.
  • There is no cellular signal, no internet connectivity, and no emergency communication infrastructure within the reserve.
  • There are no nearby medical facilities. Emergency medical response and evacuation from the reserve is time-consuming and logistically complex. Medical evacuation is entirely at the Guest's expense.
  • The rainforest environment contains venomous snakes, insects, and wildlife that can pose a risk to human health and safety.
  • Weather in tropical rainforests is unpredictable and can rapidly alter trail, river, and activity conditions without warning.
  • Activities including but not limited to jungle hikes, waterfall swims, river crossings, and night walks are physically demanding and carry inherent, non-eliminable risks of injury or death.
  • Accommodations are intentionally rustic and off-grid. Electricity, hot water, climate control, and other amenities are limited by design.
  • La Danta Salvaje makes no representations that the experience is suitable for all individuals. Guests with medical conditions, limited mobility, pregnancy, or other health concerns must consult a physician prior to booking.

Participation in all activities is entirely voluntary. By booking, you freely and voluntarily assume all risks — known and unknown — associated with the wilderness environment, travel to and from the reserve, and all activities undertaken during your stay.

4. RELEASE, WAIVER OF LIABILITY & INDEMNIFICATION

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU, ON BEHALF OF YOURSELF AND ALL MEMBERS OF YOUR PARTY, HEREBY IRREVOCABLY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE La Danta Salvaje, its owners, operators, employees, guides, contractors, volunteers, affiliates, and agents (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damage, injury, illness, or death, whether caused by the NEGLIGENCE of the Released Parties or otherwise, to the fullest extent allowable under Costa Rican law.

This release covers, without limitation: personal injury, bodily harm, illness, death, property loss or damage, emotional distress, and economic loss arising from:

  • Participation in any guided or unguided activity within the reserve
  • Travel to, from, or within the reserve
  • Exposure to wildlife, insects, plants, or environmental hazards
  • Slips, falls, river crossings, or terrain-related incidents
  • Delays or inability to access emergency medical care
  • Acts of God, weather events, or other force majeure circumstances
  • Actions or omissions of other guests
  • Equipment failure or unavailability of services

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; or (d) any negligent or wrongful conduct by you or any member of your party.

5. Reservations & Payment

  • Reservations are confirmed only upon receipt of full payment via our secure payment processor (Stripe). No reservation is held without payment.
  • All prices are in US Dollars (USD). La Danta Salvaje is not responsible for currency exchange fees or fluctuations.
  • Completion of payment constitutes your full acceptance of these Terms of Service and the Wilderness & Safety Acknowledgment presented during checkout.
  • La Danta Salvaje reserves the right to refuse or cancel any reservation at its sole discretion, in which case a full refund will be provided.
  • Fraudulent payment or chargebacks initiated without legitimate cause may result in legal action and recovery of all associated costs.

6. Cancellation & Refund Policy

  • 30+ days before check-in: Full refund minus a 10% processing and administrative fee.
  • 15–29 days before check-in: 50% refund. The remaining 50% is non-refundable.
  • Fewer than 15 days before check-in: No refund. The full amount is forfeited.
  • No-shows or failure to arrive: No refund under any circumstances.
  • Early departure: No refund for unused nights or days.

Cancellations must be submitted in writing to info@ladantasalvaje.com. The effective cancellation date is the date we receive your written notice. Verbal cancellations are not accepted.

Travel insurance is strongly recommended. La Danta Salvaje is not responsible for losses incurred due to cancellation, including but not limited to flights, transportation, gear, or other travel expenses. We strongly advise all guests to purchase comprehensive travel, medical, and trip cancellation insurance prior to booking.

7. Force Majeure & Operational Changes

La Danta Salvaje reserves the right to cancel, modify, or reschedule any booking or activity due to circumstances beyond our reasonable control, including but not limited to: extreme weather, flooding, landslides, trail damage, wildlife emergencies, government advisories or restrictions, political instability, pandemics, or other force majeure events. In such cases, we will offer a full credit toward a future stay or, at our sole discretion, a partial or full refund. La Danta Salvaje shall have no further liability and shall not be responsible for any ancillary costs or losses incurred by the Guest.

8. Guest Conduct, Safety & Right of Removal

  • Guests must follow all safety instructions provided by La Danta Salvaje staff and guides at all times. Failure to comply may result in immediate removal from the property without refund.
  • La Danta Salvaje guides have absolute authority to modify, suspend, or cancel any activity at any time based on safety, weather, or environmental conditions. No refund or compensation will be provided for cancelled activities.
  • La Danta Salvaje reserves the right to refuse entry to or remove from the property any Guest who poses a safety risk, behaves disruptively or aggressively, or violates these Terms, without any refund.
  • Guests are strictly prohibited from bringing firearms, illegal substances, or prohibited items onto the property.
  • Unauthorized collection, trapping, or disturbance of wildlife, plants, or natural materials is strictly prohibited and may constitute a violation of Costa Rican environmental law.
  • Guests are fully responsible for the conduct and supervision of all minors in their party at all times.
  • All waste must be managed in accordance with Leave No Trace principles. Guests are responsible for any environmental damage caused by their actions.

9. Medical Fitness & Emergency Responsibility

By booking, you represent and warrant that you and all members of your party are in adequate physical health to participate in wilderness activities and the physical demands of accessing the reserve. You agree to disclose any relevant medical conditions, disabilities, or health concerns to La Danta Salvaje prior to arrival.

In the event of a medical emergency, La Danta Salvaje will make reasonable efforts to assist; however, all costs associated with emergency response, evacuation, medical treatment, and repatriation are solely the Guest's responsibility. La Danta Salvaje is not liable for delays in emergency response caused by the remote location of the reserve.

  • Expert-guided rainforest activities
  • Access to all on-property experiences
  • Rustic lodge accommodations
  • Purified drinking water

NOT INCLUDED

  • Transportation to/from the reserve
  • Travel, medical, or evacuation insurance
  • Alcoholic beverages
  • Personal gear and equipment
  • Emergency evacuation costs
  • Medical treatment of any kind

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without any warranty of any kind, express or implied. La Danta Salvaje makes no representations or warranties regarding the safety, suitability, or fitness of the reserve or any activity for any particular Guest. We do not guarantee that wildlife sightings, specific weather conditions, or any particular experience will occur. Itineraries are subject to change at any time without notice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL La Danta Salvaje OR ANY RELEASED PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE. IN ALL CASES, La Danta Salvaje's TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.

13. Photography & Intellectual Property

Guests may photograph and film the reserve for personal, non-commercial use. By sharing images or videos of La Danta Salvaje publicly (including on social media), you grant us a perpetual, non-exclusive, royalty-free license to repost or use such content for marketing purposes with credit. If you do not wish your content to be shared, please notify us in writing. All commercial photography, filming, or content production requires prior written approval and may be subject to a separate agreement and fee.

14. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, any dispute arising from or relating to these Terms shall be resolved by binding arbitration in Costa Rica, conducted in Spanish, under the rules of the Centro de Conciliación y Arbitraje de Costa Rica, before resorting to litigation.

You waive any right to participate in a class action lawsuit or class-wide arbitration against La Danta Salvaje.

15. Governing Law & Jurisdiction

These Terms of Service are governed exclusively by the laws of the Republic of Costa Rica, without regard to conflict of law principles. Any legal proceedings not resolved by arbitration shall be brought exclusively in the competent courts of Costa Rica. You consent to the personal jurisdiction of such courts.

16. Severability & Waiver

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce such provision in the future.

17. Changes to Terms

La Danta Salvaje reserves the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. The Terms in effect at the time of your booking will apply to your reservation.
